Welcome to PayWall, an exclusive content marketplace enabling influencers to monetize their content instantly through seamless integration with peer-to-peer payment networks such as CashApp, Venmo, and Zelle. These Terms and Conditions (“Terms”) govern your access to and use of our websites, ipaywall.com and creators.ipaywall.com, including any content, functionality, and services offered on or through these sites (collectively referred to as “PayWall” or “the Platform”).
By accessing or using the Platform, you agree to comply with these Terms. If you do not agree with these Terms, you must not access or use the Platform.
1. Eligibility
- To use the Platform, you must be at least 18 years old and have the legal capacity to enter into a binding contract.
- By using the Platform, you represent and warrant that all registration information you submit is truthful and accurate and that you will maintain the accuracy of such information.
2. Account Registration
- To become a Creator or Customer on PayWall, you must create an account and provide accurate, complete, and up-to-date information as requested.
- You are solely responsible for the security of your login credentials and for all activity occurring under your account. Notify us immediately of any unauthorized access or use of your account.
3. Content Uploads and Creator Responsibilities
- As a Creator, you are solely responsible for the content you upload, publish, or display on the Platform. You retain full ownership of your content but grant PayWall a license to host, store, and distribute it to your Customers.
- You represent and warrant that you own or have the necessary rights and permissions to use and distribute the content uploaded to PayWall and that the content does not infringe any third-party rights or violate any laws.
- PayWall reserves the right to review, remove, or refuse to publish any content that violates these Terms or is deemed inappropriate at our sole discretion.
4. Peer-to-Peer Payment Networks
- PayWall integrates with peer-to-peer payment systems (CashApp, Venmo, and Zelle) to facilitate instant payments between Customers and Creators.
- All payments are processed directly through these third-party payment systems, and PayWall does not control or assume responsibility for the processing of payments. Any disputes regarding payments must be resolved directly between the Customer and Creator with the respective payment network.
- You acknowledge and agree that PayWall is not liable for any monetary transactions between Customers and Creators, including chargebacks, refunds, fraud, or any other financial matters.
5. Content Marketplace and Monetization
- PayWall provides a marketplace for Creators to offer exclusive content for a fee set by the Creator. All transactions and interactions on the Platform are at the sole risk and discretion of the Creator and the Customer.
- PayWall does not claim ownership of any content uploaded by Creators and is not responsible for monitoring or reviewing content for compliance with laws or regulations. Creators are responsible for ensuring that their content complies with applicable laws, including but not limited to intellectual property, privacy, and adult content regulations.
6. Liability and Indemnity
- PayWall disclaims all liability for the content uploaded by Creators and any association with the monetization of such content. Creators and Customers agree to indemnify and hold harmless PayWall, its affiliates, officers, directors, and employees from any claims, damages, losses, or expenses arising from or related to the content, transactions, or use of the Platform.
- PayWall makes no warranties or representations about the accuracy, reliability, suitability, or completeness of any content provided on the Platform. Use of the Platform is at your own risk.
7. SMS/MMS Messaging and Communication
- By providing your phone number, you consent to receive SMS/MMS messages from PayWall. These communications may include notifications, updates, marketing messages, or other information related to your use of the Platform.
- You may opt out of receiving SMS/MMS communications at any time by replying “STOP” to any message received or by contacting us at admin@ipaywall.com.
- PayWall will use SMS/MMS messaging in compliance with the Telephone Consumer Protection Act (TCPA) and other applicable regulations in the United States. Your consent to receive these messages is not a condition of using the Platform.
8. Copyright Infringement and DMCA Policy
- PayWall respects the intellectual property rights of others. If you believe that your copyrighted work has been uploaded to the Platform without authorization, please notify us by sending a written notice in accordance with the Digital Millennium Copyright Act (DMCA).
